Copies of the script are for sale. However, I am sure that copying it is not legal. Sean had some comments about how he got his copy here:

Haha, I'd forgotten I'd said this once upon a time, because I told Jon pretty much the same thing in a private message the other day. I did a Google and Amazon search for it though and couldn't find it. Only spent a few minutes looking though. Must be easy enough to find somewhere. If I remember to, I'll search by ISBN number or other info tomorrow at work (which is where my copy is). I use it all the time!

By the way, to clarify: Scripts can be bought legally, as Sean's was, but then making photocopies to pass on to others would most likely be a copyright violation.

Hmm, you may be right. Somehow though, I think it may be alright to copy, or to transcribe it, as long as it is not for resale, or to take any profit. Private use of a 'purchased' item may be different. If you buy an album for example, it is quite legal to make your own personal reproduction of it, as long as it's not put up for sale... I'd have to look that up...
"Fair Use" is the concept...you may copy for your OWN use but you may not give a copy to another person. I don't think lack of money exchange matters, they will look at it as a lost sale.

Looking at my script here at work today and noting there is no ISBN number, UPC code or similar. Just a very short, simple copyright page referencing 2008 Billy Broadway, LLC. So this product was printed (quite nicely) by the company but not mass marketed. That makes it harder to get, I suppose. Don't give up looking though, as it must be out there somewhere. If all else fails, look for it in NYC at this always-awesome event (and where I got my copy) :

Doesn't have to be for sale...they'll argue it could be later on and your harming future sales.lack of sales of any kind is brought up alot and doesn't pass the fair use law.

Okay.... here's the story: Nobody on here will be allowed to offer photocopies of any BETM script to anyone else through this forum, free or not--and that's if they can find one to purchase in the first place. Sean was very lucky to have found one that had been donated by the company of BETM Broadway to be sold legally as part of the BCEFA Flea Market to support a worthy cause that benefits the theatre community. If more are offered at some point by BCEFA, then, as he said, you should buy one if you want it.

As for the concept of fair use, if someone can get a copy for free, he/she won't buy it--why should he? That could be considered to impact sales. As a teacher, I know that schools have special guidelines for making copies of educational materials for classroom use, and they may not copy and distribute copyrighted material without following those guidelines. As a drama teacher, I had to order enough copies of scripts to cover the number of parts in a play. I certainly could not buy one script and then make copies to distribute, even if the play was not being performed for a paying audience, and I had to pay royalties regardless of whether the audience paid for tickets or not.
